Terms of Service

1. Agreement to Terms
By accessing or using gtmTower ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and gtmTower, operated by Marc Waser (sole proprietorship), Letzigraben 114, 8047 Zurich, Switzerland ("we", "us", or "our").
2. Description of Service
gtmTower is a productivity tool for Google Tag Manager. The Service consists of:
- A web application for account management, authentication, and billing
- A browser extension that enhances the Google Tag Manager interface
gtmTower is an independent tool and is not affiliated with, endorsed by, or sponsored by Google LLC or Alphabet Inc.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
- Have a valid Google account with access to Google Tag Manager
- Not be prohibited from using the Service under applicable laws
By using the Service, you represent and warrant that you meet all eligibility requirements.
4. Account Registration
To use the Service, you must create an account by authenticating with your Google account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Google Account Authorization
The Service requires you to connect your Google account to function. By connecting your Google account, you:
- Authorize gtmTower to access your Google Tag Manager data on your behalf
- Acknowledge that you have the necessary permissions to grant this access
- Understand that gtmTower will only access data required for the Service to function
- Can revoke access at any time through your Google account settings
You remain responsible for complying with Google's Terms of Service when using gtmTower.
6. Subscription and Billing
6.1 Free Trial
New users are eligible for a 7-day free trial with full access to all features. To start the trial, you must provide valid payment information. You will not be charged during the trial period.
6.2 Subscription Plans
After the trial period, a paid subscription is required to continue using the Service:
- Monthly Plan: $29 per month, billed monthly
- Annual Plan: Billed annually (pricing available at checkout)
6.3 Billing
Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew at the end of each billing period unless cancelled.
6.4 Automatic Conversion
At the end of your trial period, your subscription will automatically convert to a paid plan and your payment method will be charged unless you cancel before the trial ends.
We will send you a reminder email at least 3 days before your trial ends. You may cancel at any time during the trial period through your account settings or by contacting us, and you will not be charged.
6.5 Price Changes
We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle, not the current one.
7. Cancellation and Refunds
7.1 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent billing periods
- No partial refunds will be provided for unused time in the current billing period
7.2 Refund Policy
All payments are non-refundable, except in the following circumstances:
- Technical issues that prevent you from using the Service and cannot be resolved by our support team
- Duplicate charges or billing errors
Refund requests must be submitted to marc@gtmtower.com within 14 days of the charge.
8. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Use the Service in a way that could harm, disable, or impair gtmTower or Google Tag Manager
- Attempt to gain unauthorized access to any part of the Service
- Use automated scripts, bots, or other means to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or alter any proprietary notices or labels
9. Prohibited Activities
The following activities are strictly prohibited:
- Reselling: Reselling, redistributing, or sublicensing the Service without written permission
- Account Sharing: Sharing your account credentials with others or allowing multiple users to access a single account
- Circumvention: Attempting to bypass licensing, authentication, or security measures
- Interference: Interfering with or disrupting the Service or servers
- Malicious Use: Using the Service to transmit malware, spam, or malicious content
- Competitive Analysis: Using the Service to develop a competing product or service
- Google ToS Violations: Using the Service in a way that violates Google's Terms of Service
10. Intellectual Property
The Service, including all content, features, and functionality, is owned by gtmTower and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit written permission.
11. Third-Party Services
The Service integrates with third-party services, including:
- Google Tag Manager (via Google APIs)
- Stripe (payment processing)
Your use of these third-party services is subject to their respective terms of service. We are not responsible for the availability, accuracy, or content of third-party services.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
We do not warrant that the Service will meet your requirements or that any errors will be corrected.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GTMTOWER AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Business interruption
- Loss of goodwill
- Any damages arising from your use or inability to use the Service
In no event shall our total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless gtmTower and its owner from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the Service
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use the Service immediately ceases
- We may delete your account and associated data
- Provisions that by their nature should survive termination shall survive
You may terminate your account at any time by contacting us at marc@gtmtower.com or through the account settings.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending an email notification for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
18. Dispute Resolution
Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at marc@gtmtower.com. We will attempt to resolve the dispute within 30 days.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and gtmTower regarding the Service and supersede all prior agreements and understandings.
